Abstract: The core issue of the criminal law boundary of self-determination for late patients is about euthanasia and death with dignity. Either "self-determination"or "social determination"is a necessary but not sufficient condition for the implementation of active euthanasia. From the theoretical perspective of criminal laws,the legitimization of active euthanasia requires the combination and simultaneous compliance of "self-determination"and "social decision. "Different from euthanasia,the legitimization of death with dignity requires only the compliance of either of the two conditions.
