Abstract: There is a lot of underwater cultural heritage in our country.For not only solving the problems like the lack of funds and personnel troops’ construction,but also balancing the interests between the private and the public to promote the interests,we should allow private parties to involve in excavating underwater cultural heritage.By considering the present situation of legislation and practice of the private involvement in excavating underwater cultural heritage in many foreign countries,and combining with the relevant laws and regulations and the practical mode of Nanhai 1,we should perfect the private involvement in excavating underwater cultural heritage through legislation further.Limited intervention should be a basic principle,and the legislation should build a perfect authorization system of excavation and supervision system.At the same time,the legislation should ensure the legitimate rights and interests of the involved subject through defining their rights of usufruct by exhibiting and selling cultural relics.
